NYC Local Law 87 Amendment Passed

The New York City Council has enacted a new amendment to the Local Law 87 Rule. This amendment increases the retro-commissioning testing requirements, and is enforced on buildings filed with the city starting on January 1, 2020.

Based on its wording, any projects initially due before January 1, 2020 must also comply with the new amendment if the project will ultimately be filed with the city after January 1, 2020. This will impact all building owners / operators who have filed for extensions based on the amount of time required to address deficiencies and repairs.

To avoid having to comply with the more stringent amendment effective on January 1, 2020, New York City is permitting buildings to submit an application to be grandfathered in under the original rule. The deadline to submit this application to the city is Decem,ber 31, 2019.
